In the meantime, Hunter Biden has pleaded not guilty to criminal gun charges in a Delaware court. Today, the President’s son was arraigned on three charges related to owning a handgun while being a drug user. NBC 10’s Lauren Mayk reports from Wilmington.

This court appearance for Hunter Biden was fairly routine, lasting less than 30 minutes. Although Hunter Biden pleaded not guilty, his attorney argues that there is still an agreement in place. Hunter Biden returned to the federal courthouse in Wilmington to address the gun charges. To understand why we must go back a little more than two months to a July hearing. During this hearing, a plea deal between the President’s son and the Department of Justice prosecutors fell apart in the courtroom.

“It’s very rare for something like this to happen,” says NBC 10’s legal analyst and criminal defense attorney, Enrique Latoison. He describes the case as a political football, stating, “No one would make headlines for these types of charges if their name weren’t Hunter Biden. Regardless of whether you like him or hate him, this is a political football case.”

The political atmosphere also extends outside the courthouse. In Wilmington, a few protesters made their presence known. Meanwhile, in Washington, Republicans are launching an impeachment inquiry into President Biden, referencing Hunter Biden’s business ventures. However, no evidence has been presented implicating the President in any wrongdoing. Attorney General Merrick Garland has affirmed that no one from the White House influenced the case. This case is overseen by a special counsel who also serves as Delaware’s US attorney. Today, Hunter Biden’s attorney, Abby Lowell, released a statement asserting, “These charges are the result of political pressure from President Trump and his MAGA allies, compelling the Justice Department to sidestep the law and stray from its policies in cases like this.” The US Attorney’s office in Delaware declined to comment on these claims. The charges against Hunter Biden originated from a 2018 handgun purchase in Wilmington. The government contends that Biden falsely claimed on a form that he wasn’t using or addicted to drugs and possessed the gun when he shouldn’t have, given his drug use.

Hunter Biden’s attorney announced plans to file various motions, including a motion to dismiss, based on constitutional issues related to the law and an agreement they believe remains valid.

“They’ll argue that they relied on an agreement they thought was still effective,” Latoison comments.

Today, the judge disclosed that Hunter Biden has been in contact with a probation department in California and has passed drug tests. For Hunter Biden to remain out of custody while the case is ongoing, he must abstain from drugs and alcohol. Additionally, he must notify the court in writing about any international travel plans.
