A traffic citation here is rarely “just a ticket.” Points, suspensions, and insurance hikes can all come from one bad day, and paying the fine is the same as pleading guilty. Our firm helps drivers throughout Delaware County, Pennsylvania, protect their licenses, remove points from their records, and avoid court whenever possible. In many cases, we go to court for you so you can stay at work and avoid the stress of appearing in front of a judge.

Call Latoison Law at 610-999-1439 before you pay that ticket.
We will review your citation, explain your real risks, and tell you what we can realistically do to help.

Why A “Simple” Traffic Ticket Is Not Simple In Pennsylvania

Most people think, “It is just a ticket. I will pay it and move on.”

In Pennsylvania, paying the ticket is the same as pleading guilty. That conviction goes on your driving record and can:

  • Add points to your license
  • Push you closer to a license suspension
  • Raise your insurance rates for years
  • Make future tickets much more serious

Once you pay, it is very difficult to undo the damage.

How The Pennsylvania Point System Works

Pennsylvania uses a point system to track your driving history. Each moving violation adds points. As your points increase, so do the consequences.

Point Thresholds And Consequences

2–5 points
Your record shows points and your insurance risk goes up, but PennDOT usually does not take automatic action yet.

6 points (first time)
You must pass a Special Point Exam or attend Driver Improvement School. If you pass, 2 points are removed. If you ignore it, your license is suspended until you comply.

6 points (second time)
You must attend a PennDOT Departmental Hearing. The examiner can recommend a 15 day suspension, a special on road test, and/or Driver Improvement School. If you do not attend, you face a 60 day suspension. If a 15 day suspension is imposed, you return with 5 points on your record.

6 points (third time or more)
You face another hearing. PennDOT can impose a suspension of up to 30 days and remove 2 points once you complete the sanctions. If you fail to attend, your license stays suspended.

11 points or more
PennDOT will suspend your license. There is a schedule based on how many prior suspensions you have:

  • First suspension: 5 days per point
  • Second suspension: 10 days per point
  • Third suspension: 15 days per point
  • Fourth or more: 1 year

If you are already at 6 or 7 points, one more bad ticket can change your life.

Common Pennsylvania Traffic Violations And Points

Here is what some of the most common tickets mean under PennDOT’s point schedule.

Speeding (75 Pa.C.S. § 3362)

Over the limit – Points – Extra consequences

  • 1–5 mph over: 0 points in most zones (fine only)
  • 6–10 mph over: 2 points
  • 11–15 mph over: 3 points (plus a 15 day suspension if in an active work zone and an accident occurs)
  • 16–25 mph over: 4 points (15 day work zone suspension possible)
  • 26–30 mph over: 5 points (15 day work zone suspension possible)
  • 31+ mph over (excessive speeding): 5 points and a mandatory PennDOT hearing, with a possible 15 day suspension and/or on road exam

Real Client Example: 40 mph Over The Limit

Over 25 years of legal experience

    Call 610-999-1439

A prior client was cited for driving about 40 mph over the limit, which fell in the “31+ mph over” category. That meant:

    • 5 points
    • A mandatory PennDOT hearing
    • A real risk of a 15 day suspension

They also had a critical work meeting the same day as court and could not afford to miss it.

    We:

    • Filed our appearance
    • Went to court without the client
    • Negotiated the speeding down to a non points violation

    The result:

    • No points
    • No PennDOT hearing
    • No suspension
    • No insurance spike

The client never set foot in a courtroom and did not miss work. Results vary by case, but this is the kind of outcome we work toward.

    Other Common Moving Violations

Below are some of the violations we see most often and their typical consequences in Pennsylvania:

    • Driving too fast for conditions (§ 3361): 2 points, and a 15 day suspension if in an active work zone with an accident
    • Failure to stop for red light (§ 3112(a)(3)): 3 points
    • Failure to stop at stop sign (§ 3323(b)): 3 points
    • Failure to yield right of way: usually 3 points
    • Improper passing (§ 3305 and related): usually 3 points
    • Following too closely (tailgating) (§ 3310): 3 points
    • Careless driving (§ 3714): 3 points, with enhanced penalties if there is serious injury or death
    • Failure to stop for a school bus (§ 3345(a)): 5 points and a 60 day suspension
    • Reckless driving (§ 3736): No points, but an automatic 6 month suspension and no Occupational Limited License is available

This is why “just paying the ticket” can be a very expensive mistake.

DUI And Driving While Suspended: The High Impact Offenses

Some offenses go far beyond points and have severe license consequences.

DUI Suspensions In Pennsylvania (Simplified Overview)

    DUI penalties depend on:

    • Your BAC level
    • How many prior DUIs you have
    • Whether you are eligible for ARD (Accelerated Rehabilitative Disposition)

Typical license suspensions for non ARD adult cases include 12 to 18 month suspensions depending on your BAC level and prior history. ARD often carries much shorter suspensions ranging from no suspension to 90 days, depending on the circumstances.

A DUI conviction also brings fines, possible jail time, mandatory classes, ignition interlock, and long term consequences for future sentencing.

    Driving While DUI Suspended – § 1543(b)

If you are caught driving while your license is suspended because of a DUI, penalties are extremely serious. For example:

    • First offense: at least a 500 dollar fine, 60 to 90 days in jail, and an additional 1 year suspension
    • Second offense: at least a 1,000 dollar fine and 90 days in jail
    • Third or later: at least a 2,500 dollar fine and 6 months in jail

Some parts of the law that tried to add longer mandatory minimums have been challenged, but the core penalties remain very harsh.

    No Insurance And Registration Problems

    Driving Without Insurance – § 1786

If you drive without the required insurance, or allow someone else to drive your car without it, you may face:

    • A 3 month registration suspension
    • A 3 month license suspension if the vehicle was actually operated
    • A 300 dollar fine, plus restoration fees

There is a 500 dollar civil penalty option that can be used instead of the 3 month registration suspension in some cases, but it can only be used once every 12 months and you still must show proof of insurance.

    Driving Without A Valid License – § 1501

Driving without a valid license can result in:

    • A 200 dollar fine on a first offense if you can show you were licensed but expired within a year
    • For repeat offenses within five years, PennDOT can impose a 6 month suspension, higher fines, and even jail time

    The Hidden Cost: Insurance

Insurance companies pay very close attention to moving violations.

Each time you are convicted, they see increased risk. That often means:

    • Significant premium increases for a single speeding ticket
    • Hundreds or thousands of dollars in extra costs over the 3 to 5 years they rate that violation
    • In more serious or repeated cases, cancellation of your policy and forced placement into high risk pools

A cheap fine today can easily turn into 1,000 dollars or more in long term insurance costs.

We Go To Court So You Do Not Have To

One of the biggest advantages of hiring Latoison Law for a traffic ticket is that in most Pennsylvania traffic cases we can appear in court for you.

    • You do not have to drive in from out of state
    • You do not sit for hours in a courtroom waiting for your case to be called

    We handle:

    • Negotiations with the officer and prosecutor
    • Arguments to the judge
    • Plea discussions to seek no point or reduced point outcomes
    • Follow up on your record and PennDOT consequences

    • Your job
    • Your family
    • Your life

How Latoison Law Fights Your Traffic Ticket

When you hire Latoison Law, here is what we actually do for you.

    1. Deep Review Of Your Case

    We look at:

    • The exact statute or statutes you are charged with
    • The officer’s narrative and any video, where available
    • Your driving history and current points
    • How this ticket affects suspension risk and insurance

    2. Identify Defenses And Leverage

Depending on your case, we may:

    • Challenge the speed timing device (calibration, training, location)
    • Question whether the stop was lawful
    • Examine signage, visibility, and road conditions
    • Look for errors on the citation or procedural mistakes
    • Argue for no point or reduced point alternative charges

    3. Negotiate With Officers And Prosecutors

    In many courts, we can:

    • Get speeding tickets reduced to non point violations
    • Convert some moving violations into no point, non moving offenses when appropriate
    • Avoid school bus, reckless, or excessive speed suspensions where the facts allow

    4. Show Up So You Do Not Have To

We appear in front of the judge on your behalf, present your side, and handle all of the legal details.

    5. Protect Your Long Term Interests

Our goals in every case are to:

    • Avoid or reduce points
    • Avoid suspensions whenever legally possible
    • Minimize insurance impact
    • Keep your record as clean as the circumstances allow

License Already Suspended? There May Still Be Options

If PennDOT has already suspended your license, everything is not necessarily over.

    We can:

    • Review whether the suspension is legally correct
    • File appeals where appropriate and within deadlines
    • Represent you at civil license suspension hearings
    • Explore Occupational Limited License or Ignition Interlock Limited License options where available

The sooner you contact us after receiving a suspension notice, the more options we are likely to have.

The Cost Of “Just Paying The Ticket” Versus Hiring An Attorney

    Just paying the ticket

    • Fine: often 100 to 300 dollars or more
    • Points: 2 to 5, sometimes more
    • Insurance: often 300 to 500 dollars or more per year for several years
    • Suspension risk: very real if you are near 6 points, 11 points, or facing serious charges
    • Lost time: missed work and stress if you go to court on your own

    Hiring Latoison Law

    • Attorney fee: varies by case, but often less than the long term cost of points, suspension, and insurance hikes
    • In many cases you do not have to appear in court
    • Real opportunity for:
      • Reduced or no points
      • Avoided or reduced suspension
      • Lower long term costs

Take The Next Step – Before You Pay That Ticket

    • Pleaded guilty
    • Put points on your record
    • Triggered insurance consequences
    • Limited what an attorney can do to fix it
