Can Drug Users Own Guns? New Ruling Explained
A new Supreme Court ruling could change how some firearm possession cases involving drug use are prosecuted.
In this video, Pennsylvania criminal defense attorney Enrique Latoison explains that the ruling does not erase all firearm restrictions tied to drug use. Lying on a gun application is still a separate issue. However, when the charge involves a known drug user possessing a firearm, prosecutors may now have to prove more than drug use alone.
According to Enrique, the major change is that the government may need to show that the person was both a drug user and dangerous. That creates a different burden for prosecutors and may affect future cases involving marijuana, controlled substances, and firearm possession.
