Understanding the Dismissal of Charges Against Alec Baldwin

(0:00) I’m Enrique Latoison, this video is brought to you by Commentary Creations, your 3-minute lawyer. (0:10) We are going to talk about Alec Baldwin and his charges being dismissed after a very public charging of the very famous actor. (0:30) Interestingly, in this day and age, as a defense attorney, I’m starting to see a little something where I see prosecutors that are looking to be (0:40) a little too famous for doing their jobs. The way it works is the defense attorneys are the famous ones. But what I’ve seen lately is (0:50) that there are prosecutors doing things that are a little outside of the box or a little unethical. I will say Donald Trump’s lawyer, whether you (1:00) love Donald Trump or hate him, made a very interesting point in a press conference after Donald Trump was charged, where he said “No one should be above the law, and no one should be below the law. (1:10) I really thought that hit home. The first thing we have is, we have an Andrea Reeb that was (1:20) appointed special prosecutor in this case. First, she served in the legislature at the time, (1:30) yet became a special prosecutor. What you learn in law school, day 1, separation of powers, you probably learned this in high school. There is a big conflict of interest there. (1:40) There also were some issues with some comments made about this being good for her career. So now when you take a step back, and you look at that and you look at what he was charged with, (1:50) The charge that carried the most time, or was a very severe charge against him, wasn’t even a law until 7 months after the shooting in this case. (2:00) That’s also law school 101. You can’t charge any American citizen for something that is not even a law. Something happens, and then becomes a law later and then you get charged? (2:10) You didn’t even know it was a crime at the time. So, that charge was dismissed. (2:20) There was the shooting during the filing of the “Rust” movie, where Mr. Baldwin was given a gun from the armorer and didn’t know that the gun was loaded, according to his attorneys. (2:30) The gun goes off and very tragic, Ms. Hutchins was killed, struck by that bullet. So, after that, this was deemed an accident, and many months later, (2:40) after Mr. Baldwin settled with the family of Ms. Hutchins, and after that charges were filed. (2:50) There was a very public display of these charges, and only through motions of charges being dropped (3:00) starting with the charge that wasn’t a crime at the time that was put against him, and things being downgraded, and finally the special prosecutor having to resign from the case. (3:10) She should have never been on the case to begin with, and then we find out after two new prosecutors were appointed, probably prosecutors that (3:20) are not having a political agenda, who are simply doing their job and looking at the facts. And I will say for the record, this is not a video of whether Baldwin is innocent or guilty. (3:30) This is a video dealing with the justice of what we are talking about here when people get charged. So, two new prosecutors come in who don’t have a political agenda, (3:40) and now all charges are going to be dropped against Mr. Baldwin. As prosecutors often do, they say they have a right to refile, they have a right to refile these charges after they withdraw them. (3:50) They are still pursuing the charges against the armorer who was essentially responsible for making sure that firearm was safe (4:00) before Mr. Baldwin picked that gun up and the death unfortunately occurred. So, this video while might be about Mr. Baldwin, is more about (4:10) the fact of, I take great issue anybody abusing their power, no matter what it is, to put forth some sort of political agenda (4:20) or to try to use their power to move up in life. It is a disservice to all of us as American citizens, defendants and everyone.
